Welcome to Total Tech, LLC (the “Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, https://totaltechwnc.com/ (the “Site”). By using the Site, you agree to these Terms. If you do not agree, you must not use the Site.

These Terms cover the Site itself. Work we perform for you is governed by our Services Terms, and our handling of your information is described in our Privacy Policy.

1. Website Use

The Site provides information about our services and also supports customer transactions — including requesting a quote, approving and electronically signing estimates, viewing and paying invoices, tracking service in progress, and managing a membership or account.

Browsing the Site does not by itself create a client relationship or guarantee services or results. A formal service engagement begins with a written estimate, agreement, or invoice, and the work we perform is governed by our Services Terms.

You agree not to misuse the Site, attempt unauthorized access to it or to another customer’s information, interfere with its operation, or use automated means to scrape or overload it.

2. Accounts & Portal Access

Parts of the Site — including the client portal, invoice payment, estimate signing, service tracking, and membership pages — require an account or a secure access link.

You are responsible for the accuracy of your account information and for keeping your password confidential. Activity that occurs under your account is your responsibility.

Access links. Some pages are reached through a private link we email or text you rather than through a login. Treat those links as confidential — anyone who has the link can view the invoice, estimate, or service record it points to, so please do not forward them to people you do not want to have that information.

Please tell us promptly, using the contact information below, if you believe your account or an access link has been used without your permission.

You must be at least 18 years old to create an account, approve an estimate, or make a payment through the Site.

We may suspend or close an account that we believe has been compromised, or that is being used in violation of these Terms.

3. User Submissions

If you submit information through our forms (e.g., request a quote, contact form, email sign-up), you agree to provide accurate, current, and complete information.

By submitting, you consent to us contacting you using the information provided, including by text message and email as described in Section 4.

You may not submit false, fraudulent, or unlawful content.

4. Text Messages & Email Communications

When you contact Total Tech, LLC to request an estimate, schedule service, or ask about our services — through a form on this Site, by phone, by email, or in person — and you give us your mobile number or email address, you consent to receive text messages and email from us at that number and address, as described in this section.

Text messages. We send recurring automated service and transactional text messages about the work you requested, including appointment confirmations and reminders, technician en-route alerts, estimate and invoice notifications, payment receipts, service updates, and review requests. No promotional or marketing text messages will be sent.

Message frequency varies. Standard message and data rates may apply. Reply STOP to opt out at any time, or reply HELP for help. Carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not a condition of purchase, and opting out will not affect your service — we will simply reach you by phone or email instead.

We will never share or sell your mobile number or your text-messaging consent to third parties or affiliates for marketing or promotional purposes. Your number is shared only with our messaging provider, in order to deliver the messages described above.

Email. We send transactional email about your service — estimates, invoices, appointment confirmations, and receipts — and we also add you to our mailing list for occasional company news, seasonal tips, and promotional offers.

Every marketing email includes an unsubscribe link. You may unsubscribe at any time without affecting your service or the transactional email you need about work in progress.

5. Payments

If the Site offers online payments (e.g., deposits, invoices, or service fees), processing is handled securely by Stripe, Inc.

When you pay through Stripe, that payment is also governed by Stripe’s Consumer Terms of Service and Privacy Policy. Stripe handles your payment information independently of us, under its own agreement with you.

We do not store your full payment card information on our servers.

6. Electronic Communications & Signatures

By using the Site and giving us your contact information, you consent to receive communications from us electronically — including email, text message (see Section 4), and notices shown in your account or portal — and you agree that those communications satisfy any legal requirement that a notice be in writing.

Electronic signatures. When you approve or sign a document through the Site, such as an estimate, work authorization, or membership agreement, you agree that your electronic signature, click-to-accept, or typed name has the same legal effect as a handwritten signature, and that the resulting record may be enforced as an original.

We keep an electronic record of documents signed through the Site, including the date and time of signing, and will provide you a copy on request.

You may withdraw your consent to transact electronically by contacting us, though we may then be unable to offer some parts of the Site.

7. Cookies & Tracking

The Site uses cookies and similar technologies to keep the Site working, understand how it is used, and measure the effectiveness of our advertising.

We currently use PostHog for product and usage analytics, and Google Ads conversion tracking to measure responses to our advertising. These tools may set cookies or similar identifiers in your browser.

By using the Site, you consent to the use of cookies as described here.

You may adjust cookie settings in your browser or use your browser’s Do Not Track and tracking-protection features, but some parts of the Site may not function properly if cookies are disabled.

8. Intellectual Property

All content on the Site (including text, graphics, images, layouts, and design) is owned by Total Tech, LLC or its licensors and is protected by copyright, trademark, and other laws.

The logos of our industry partners and respected brands displayed on the Site belong to their respective trademark owners and are used only for reference. Total Tech, LLC does not claim ownership of these marks.

You may not copy, reproduce, distribute, or create derivative works from Site content without prior written consent.

9. Third-Party Links

The Site may contain links to third-party websites or tools. These are provided for convenience only.

We are not responsible for third-party content, practices, or availability.

10. Accessibility

We want the Site to be usable by everyone, and we work toward conformance with recognized accessibility standards.

11. Disclaimers

The Site and its content are provided “as is” and “as available.”

We make no warranties, express or implied, regarding accuracy, reliability, or suitability of the Site’s content.

The Site is not a contract for services and should not be relied on as a guarantee of specific results.

12. Limitation of Liability

To the fullest extent permitted by law, Total Tech, LLC, its owners, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of or reliance on the Site, including lost data, lost profits, or loss of use.

Our total liability for any claim arising out of the Site is limited to the greater of the amount you paid us through the Site in the twelve (12) months before the claim arose, or one hundred dollars ($100).

Any claim arising out of your use of the Site must be brought within one (1) year after the claim arose, to the extent permitted by law.

Nothing in these Terms limits liability that cannot be limited under North Carolina law, including liability for gross negligence, willful misconduct, or bodily injury caused by us.

13. Indemnification

You agree to indemnify and hold harmless Total Tech, LLC, its owners, employees, and contractors from claims, damages, and reasonable expenses arising out of your misuse of the Site, your violation of these Terms, or your violation of the rights of any third party.

This does not apply to claims arising from our own negligence or misconduct.

14. Suspension & Termination

We may suspend or restrict access to the Site, in whole or in part, at any time and without notice, including to protect the Site, our customers, or our business.

We may remove content submitted through the Site that we believe is false, unlawful, abusive, or in violation of these Terms.

Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — continue to apply.

15. Governing Law & Disputes

If you have a concern, please contact us first — most issues are resolved quickly with a phone call.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules.

Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Henderson County, North Carolina, and both parties consent to that venue.

16. General Terms

Severability: If any provision of these Terms is found unenforceable, that provision is limited or removed to the minimum extent necessary and the remaining provisions stay in full effect.

No waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment: You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of our business.

Entire agreement: These Terms, together with our Services Terms and Privacy Policy, are the entire agreement between you and us regarding the Site.

17. Changes to the Terms

We may update these Terms from time to time. Updates take effect when posted to this page with a revised Effective Date.

Continued use of the Site after updates means you accept the changes.
